Car loan disbursed but fraud delear not delivering the car

Car dealer has taken the full payment of car and refusing to inform when the car will be delivered even after the company provided waiting period of 6 weeks is over. How to proceed legally and get a refund. The money was disbursed without our consent from HDFC Bank when dealer spoke to loan agent and provided some fake information about car allocation.
Initially you may give legal notice to them. If they do not respond then you proceed to file the case in consumer court. You can file in consumer court in your jurisdiction. If you have any questions please contact me.
