Can Bank ask for credit card payment and report in cibil

20-Apr-2025 (In Recovery Law)
Can a bank ask for credit card recovery after 12 years when there has been no contact between both the parties in these 12 years and no transactions. Also since the then bank is reporting the card as write off for these 12-13 years since 2012.

If there has been no acknowledgment of debt or any payment made in the last 12 years, and the bank has reported the account as written off since 2012, then the claim is barred by limitation under the Limitation Act, 1963. As per Article 62 or Article 113 (depending on the nature of the agreement), the limitation period for recovery of debt is 3 years from the date of default or the last acknowledgment. After 12 years of no communication or transactions, a recovery claim would generally not be maintainable in law unless there's valid proof of acknowledgment within that time.

No bank cannot ask for credit card recovery after 12years. Aa per limitation act, it The as to be recovered within 3 years and that time has already expired. It’s just a matter of chance that the card is reported write off; bank could still recover the amount had it been within the limitation period.
