Under the Consumer Protection Act, 2019, a complaint can be filed under Section 2(42) for “deficiency in service” against the builder. If the builder has not provided quality work, delayed completion, or violated the terms of the development agreement, a complaint can be filed before the Consumer Commission depending on the claim amount.
Since the builder is allegedly constructing shops in the parking space without approval, it amounts to unfair trade practice. You may also seek an injunction under Section 38 of the Real Estate (Regulation and Development) Act, 2016 (RERA), if applicable.
Additionally, if the builder is not providing a copy of the development agreement, a legal notice can be issued, and if still not complied with, a writ petition under Article 226 of the Constitution may be filed before the High Court seeking necessary relief.
