Builder harresment to cancel the shop

Hello , i booked a shop with builder in noida and got BBA , RECIPT, Allotment Emails all after few days they called me and forcing me to cancel this and surrender all docs because their sales by mistake sold same shop to other buyer .. now they call me often and harress me to cancel it & take another shop and pay extra because other shops are bigger then this .. i do not wanted to cancel and already paid 50 % as they demanded and rest will be on possession but they still harass to cancel .

First of all rather than going legally you should serve him a legal notice and in that notice you can write that either give me the possession of the property or pay back my money or face legal action which will be at your own risk. After that if he fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations. you can file a case for specific performance of the contract. the court after considering all the documents and receipts etc. can order the builder to transfer the shop in your name. in the alternative you can also seek compensation and return of your money for breach of contract by builder. obtain a stay on the property to prevent the builder to transfer it to someone else. should you have any queries feel free to contact me.

File a complaint with RERA regarding the harassment made to you by the builder and demand for refund and compensation. Also parallelly register a complaint before Police and Concerned Magistrate under criminal conspiracy and fraud to build pressure on them. Remember you are fighting with a giant company so I suggest you to presented case properly.
