Builder delaying repairs in flat, despite repeated reminders

31-Jul-2023 (In Recovery Law)
Even after 2 years of possession, the builder is delaying repairs in flat, despite my repeated reminders via phone calls & messages. Walls peel off & water leaks in the kitchen. Building is yet to get Occupancy Certificate. nWhat should I do now?nWhich court should I file the case in & how much will the fees be? (Flat in Mumbai, priced at Rs. 1.2 crore & Compensation amount is Rs. 2 lakhs)nWill such a case stand in the court, given that the builder is yet to receive the OC & 2 years are over?

Firstly, you should've not taken the possession of your flat if the builder has not obtained OC. Offering or accepting possession without OC is unlawful. However, if you have taken the possession and requested the builder to obtain OC multiple times and he ignores, you have the right to file a consumer case. Your matter will go to the State Consumer Court because of your case valuation. Your case definitely stands in court since the builder has not obtained OC yet and has therefore committed deficiency of services. For fees and other details, you can approach me.
