Will original owner take consent of POA holder to sell/cancel property

26-Oct-2023 (In Property Law)
I hold a under construction property , registration is already done on the name of two owners holds the same share. I hold the power of attorney of the second owner which was used during registration as second owner was not available. May i know if second owner now can sell/cancel property without my consent?

Power of attorney does not make you the owner of the property- it is also held by the hon'ble Supreme Court. If you have sold the property without the consent of the original owner, he may challenge the same in court and can also file Criminal case against you

You are only a POA holder for the Second Owner, which means the second owner has only authorised you to do some act on his behalf, but that dosent mean that yo become owner of the same. Owner of the property has all right to sell his property without any consent from you.

The second owner will be required to terminate the Power of Attorney first. He will need to send you a cancellation POA and the same needs to be notified in the Registration office. After that he can do the needful.
