will (Mrutyupatra) created by grandfather
17-Feb-2026 (In Property Law)
will (Mrutyupatra) was created by my grandfather, so wanted to know the process and possible scenarios
If your grandfather has made a Will (Mrutyupatra), the first step after his death is to verify whether it is registered and who is named as executor. If the property is situated in Mumbai, Chennai or Kolkata, probate from the competent District Court is mandatory. In other places, probate is advisable but not always compulsory unless disputed.
The executor must file a probate petition with original Will, death certificate and details of legal heirs. Notices will be issued to all heirs. If no objection is filed, probate is granted. If any heir objects, it becomes a contested proceeding like a civil trial.
After probate, property can be mutated in beneficiary’s name. If no Will exists or Will is invalid, succession will be as per personal law. Consult a local advocate with the original Will for proper guidance.
