Will is not registered how will the property division be done
05-Jan-2023 (In Property Law)
My grandfather has a house and he is no more, it's been 15 years. My grandfather has four sons and he made a will oin which he has given property to fourth and third son. But the will was not regestered. I am son of fourth son and my dad is also no more. The house is still on my grandfather's name. We and the third son of grandfather lives in that house. First two have there own house. Second and third is also died. According to will 75% percent is given to us and 25% to third. But the will is not registered. And my father's three brother are together and want us to sell the house but we don't want to. So they send us notice from lawyer. My question is can we now registered the will or not? And what should we do?
Dear sir,
A will does not have to be registered for it to be valid. It must be signed by the person making it and must have signature of two witness.
At present you should reply to the notice issued by your relatives.

No,
You can't registered your grand father will now.
But you can get prober certificate on will of your grandfather and there is no requirement to register a will.
If your grandfather will have two witnesses sign.
You definitely get prober from court.
