Will be okay to mention name of a person on will who is facing law

My grandfathet wants to make a will on my name , my brothers name and my dads name . But the problem is there are few cases going on in court on my dad like rape , maintainance , bank loan not repayed . So will it be okay to add my dads name in will or not .
There is nothing wrong to include name of your father in will, however if there is any pendency of payment on his account and court gives decision against him that amount can be realised out of that willed property after it go transfer in your father's name after demise of your grandfather.
it would be better to not mention your fathers name as he has many recovery cases on him and if he looses them his share can be taken over legally by the other party. So to be on a safer side it is advisable to not have your fathers name on the will
