23-Nov-2024 (In Property Law)
After father's death ,my grandmother got her name in succession along with me and my mother. My question is my grandmother's died and wrote a will without our(myself (son) and my moms ) knowledge to my uncle who is my grandfathers brothers son what is the law? and we have a suspect that my uncle cheated or forged the will because the written of will is not in our presence and it was written 10years back and we came to know about the will jsut 3 months back what to do

According to law if a person dies intestate (without writing any will/settlement); his properties and assets will be inherited by all his surviving legal heirs such as wife, children & mother. So, your grandmother’s name was included in your father’s legal heir certificate. And, your grandmother has the authority to give her share only, so if she had written a will regarding her share alone, it’s legit. But if the Will deed was about the whole property, then it amounts to usurping your share by deception. So you have to immediately take appropriate steps to impede this process legally.
