Hi. Hope you are well, My husband passed away due to covid on April 16 this year. I have a 3 year old son. I am not very sure how the property will be divided and when and I am in dire need of money to pay off some loans which my late husband had. Apart from my husband my mil also succumbed and now I am left with a father in law and a sister in law who is a spinster. Please could anyone tell me how does property division work in this case and how soon can I assume them as I am only left with my son.

You’ll have to obtain letters of administration from court. It will dwell onto you and your son, you acting as the son’s natural guardian. Once you get a grant from court the property gets transferred into your name.

you are eligible to entire share of your husband. but u cannot claim anything from your father in law's property till he is alive. after his death u r eligible of u r unmarried. but your son shall be eligible in any case as his grandson. you have not described the property type and/ or asset whether it's moveable or immoveable. pls call for further details. thanks and regards adv. jenal busa
