Widow mother in law wants to gift her share

12-Apr-2023 (In Property Law)
My father in law expired 7 years ago. My grandfather in law also not in exists. Whole property is purchased by my grandfather in law after 1960. And now all property is on name of all members of my joint family including mother in law, husband, brother in law, and my husband's four uncles. Can my mother in law gifts her share of my grandfather in law's property to my brother in law?

First of all since the property has been purchased by your grandfather in law it will be divided amongst all his legal heirs equally following which of anybody wishes to transfer their share in favour of the other family members then in that case you will have to draw a release deed thereby releasing their share in the property

She can gift her own share to Brother in Law, there is no problem in it. If you want to raise objections, you will not be entertainer in court except under certain conditions. To know, what such conditions through which you can restrict such Gift Deed transfer will be explained to you on call.
