the rights are governed by the hindu succession act if there is no will of the property and as per the same the legal heirs of Class 1 heirs are given the first right in the property. there is a schedule in the Hindu succession act according to which the property devolved. it starts with Wife/husband, sons and daughters and so on. if the person has died before 2005 then the daughters will not be entitle to any share in the property.

To answer that you should at least provide details of religion and details of family members (living and dead) as this is a very open ended question. Every legal heir of the owner to the property including mother, widow, son and daughter have a rightful claim to the property. For a specific opinion ask the exact and precise question.
