Who gets the LIC claim ? Mother ( is nominee) or Kids?

My wife has passed away. She has an LIC policy where my mother in law is the nominee. I have a kid ( minor) who is not the nominee. My mother in law is refusing to share any of the claim proceedings for my son. What are my options? I read somewhere that if a married woman passes away, the insurance claim can be done by husband and kids irrespective of the nominee. The nominee is only the custodian of the money. Is this correct? How should I approach this legally?

hi sir as per your facts you and your son are true contenders for the rightful amount. certainly nominee is only custodian. the custodian has an obligation to distribute the benefits equally among beneficiaries. case for recovery has to be filed.

Yes correct, Nominee is custodian of amount which they received through bank or any from any Bank. Real successor or legal heir can seek recovery of money by filing civil suit for recovery before Civil court
