hi we bought a landlord share flat from landlord. we have sale deed. in sale deed or aos our landlord not motioned date of possession. But our landlord and developer made JDA cum irrevocable general power attorney.in jda project completion details available. In this jda my flat details are available and in my sale deed our landlord mentioned this jda document number its 50 page doc so he said more fully described in jda and given doc no if i file case which date the court considered DOP ?

In the absence of a specific Date of Possession (DOP) in your Sale Deed or Agreement of Sale, the court will not automatically adopt the JDA date as the DOP merely because it is referred to by document number. Settled Legal Position: The Sale Deed is the primary and governing document between you and the landlord. Reference to a JDA/GPA in the Sale Deed does not import all its terms by default, unless possession is expressly stated to be delivered on a particular date. Courts determine DOP based on actual possession, proved through: Occupation, Completion certificate, Electricity/water connections, Property tax assessment, Handing-over documents, or Date of project completion relevant to your specific flat. Practical Outcome: If litigation arises, the court will consider the date on which the flat became fit for occupation and was actually handed over, not merely the JDA execution date. A blanket reliance on JDA project completion date is legally unsustainable unless possession is clearly linked to it. Next Step: A document-by-document review is essential to fix the legally defensible DOP for limitation, possession, or relief claims.

Hello, From what you have stated, the key point is this: Your registered sale deed is the primary document for your rights. Even if it refers to the JDA document number for project details, the court will mainly rely on the sale deed, not the internal JDA between landowner and developer. Since the sale deed does not mention the Date of Possession, the court will determine possession based on: Whether the sale deed states that “vacant possession is delivered” Actual physical possession Handover letter (if any) Electricity/water/property tax records Date you started occupying the flat The JDA only governs the relationship between landowner and developer. It does not automatically fix your possession date unless your sale deed specifically adopts a possession clause from it.
