whether i can claim property if my elder brother and his wife died.

with reference to the above whether i can claim property of my brother and sister in law because they did not have child. My brother left one flat and FD's in bank. In some of FD's he mentioned my name and in flat as nominee.

Dear queriest, as per your query you have mentioned about the fact that you want to claim the nomoveable and moveable property of your brother and his wife, since he has mentioned you nominee in the flat, yes you can claim for the same if he is not having any child and also if he has mentioned you as his nominee.

Dear Querist, under Hindu law you are entitled to but any government authority would expect a documentation or certification from a court that you are legal heirs of both of them and that they have no children. Better apply for Succession certificate of the person who expired last.
