What will be daughter's share in fathers property
27-Oct-2023 (In Property Law)
Dear sir..I am 32 years hindu person. My Grand father have 3 sisters and one Brother( My Father). So at the time of My Grand father alive he gave me the will(non registered) of his own property( not a ancestrial) in the name of mine. and died in the year of 2000. My grand mother gift the Property with my name. Now i need to construct the house and applied for loan. He is saying that i have no right in that property. and he is saying that the property have and equal right to all the sons and daughters. please clarify with examples and favour me to get the loan.
If property belonging to your father & he passed away before 2005 then only yourself and your mother are entitled to enjoy the same as an class -1 legal heirs and your sisters are not entitled for the same as per amended section 6A of Hindu section act as recently held by Supreme Court and it has been contended that if father is alive after 2005 then only female siblings are entitled for share in father property. If father is dead before 2005 then female siblings are not entitled for fathers property as per Hindu succession act.
HI
The will should be probated in the court of law .
Since your gran mother has gifted the property to you( i presume it is registered) you have every right on the property.
Now banker might have concern since the WILL is not probated.
please get the will probated in court of law.
