What to do when the developer asking for additional charges

Hi, I have booked a flat with a developer in mumbai last week and have paid a heavy token amount via RTGS, I am awaiting to get the flat registered and now the developer is quoting additional charges as possession charges, apart from the ones quoated in the booking agreement, what legal action can i take now or what should I do

This is my response to you: 1. If the project is RERA registered then you can file a complaint; 2. If not then you can send a legal notice asking him to not make such arbitrary demands; 3. If he still does not forego the amount then you can file a consumer complaint against him; 4. As per RERA or MOFA the builder cannot make extra charges other than specifically mentioned in the Deed; 5. If he does then he can be tried in the courts.

Sirji, u can file a consumer complaint under consumer protection act. And also make a complaint to RERA for this. And there is also remedy avialable in civil court. Make a complaint under RERA Act. And then in consumer court it is suifficient to u. In my opinion

First send legal notice through Advocate.

you should proceed with notice and claim for the possession of said flat. it is mandatory to registered agreement if you had paid the token amount. you have also right to file complaint before court under MOFA .
