What to do when the developer asking for additional charges
26-Jul-2023 (In Property Law)
Hi, I have booked a flat with a developer in mumbai last week and have paid a heavy token amount via RTGS, I am awaiting to get the flat registered and now the developer is quoting additional charges as possession charges, apart from the ones quoated in the booking agreement, what legal action can i take now or what should I do
This is my response to you:
1. If the project is RERA registered then you can file a complaint;
2. If not then you can send a legal notice asking him to not make such arbitrary demands;
3. If he still does not forego the amount then you can file a consumer complaint against him;
4. As per RERA or MOFA the builder cannot make extra charges other than specifically mentioned in the Deed;
5. If he does then he can be tried in the courts.
As per your query

You can file complain against that person under rera act. First send legal notice through Advocate.
