23-Jun-2023 (In Property Law)
Sir, Need to know about a solution related to incorrect plot no registered against my grandfather.A friend of my Grand Father transferred some land having different plot no around 1975.But one of plot was incorrectly registered as 138 in place of 178.That person has expired and had no offspring and other blood relations alive. My grand father is also no more.During division of lands among my father and uncles it came to the notice. Please let me know how it can be corrected as other plots have been correctly registered except this one. Regards

This can be rectified. Find out that at present correct plot is under whose possession. Then contact a good lawyer, approaching about all facts, docunents/ papers and act accordingly as per his advice.

You need to institute a Title Suit in Civil Court seeking declaration that there was merely typographical error in writing Plot Number of the property whose all other descriptions are/were correct such as boundary, place, Khata Number etc. It is further needed to get declaration of Title on the property. Inasmuch as no one of the then Seller is alive, therefore the Title Suit will be instituted by you father or uncle as plaintiff arraying the other members of the family as defendants. all the parties will support each other in the suit and accordingly a competent decree and judgment will be delivered by the learned Court. In suit, it will be needed to place evidence that the wrong Plot No. 138 did not belong to the then vendor and that the correct Plot No. 178 did belong to the then Vendor who sold the same to your grandfather.
