What to do if property is acquired by an individual
24-Jun-2023 (In Property Law)
My grandfather have 4 other brothers and all property is of on big brother name and he is not ready to distribute the property so what can i do ?
If the property is in the name of the eldest brother and is a self acquired property and not an ancestral property, then you can do nothing about it. However, the other brother's can file a recovery suit if they also contributed financially in the acquisition of the property.
If the property is ancestral then the other brothers can file a suit for partition of property and later file for cancellation of mutation if the mutation has been done in eldest brother's name.
If it is an ancestral property then definayely the is your right vested in it through your father. In other case it is self acquired and only with the ownership of your grandfather's then don't have to worried about it and forget it. But the case has to be discussed on call or face to face in detail as there are 3rd generation is involved. We need to know how many shareholders are alive, what is the nature of it, is there any will for it, etc etc...
