what rights in property dispute amongst sisters in absence of will
15-Aug-2023 (In Property Law)
I have been staying in my house with parents for last 30 years. My father did not leave a will. Now my remaining 4 sisters have encroached the house and demanding their share. They want to sell the property. My problem is I have been staying in this house and don't want to get uprooted and go elsewhere.
Amendment , the Hindu Succession (Amendment ) Act ,2005, amended sec.4 & sec.6, sec.23, sec24,& sec.30 of the Hindu Succession Act,1956, it revised rules on coparcenary property , giving daughters of the deceased equal rights with sons & subjecting them to the same liabilities & disliabilities. In case of self acquired property the person is free to manage the property according to his own will. your father had not made wil. in such case daughter has equal rights on the property. u purchase their share so u can live that home .
Technically if the house is successes by you, then your sister have right to ask for share but nobody can dispossessed you without order of any court. Therefore don't worry you can stay there and if they are bothering you badly then you can file a suit for injunction seeking relief of restraining them from creating disturbance to your possession.
