What is the share of wife and son if the husband died without a will

31-Jul-2023 (In Property Law)
Grand mother purchased a land alloted among his three sons with legal papers. But her youngest son died without any will. He left his wife and son. Both will have the 50:50 rights on the land or the wife only has the right on it?

A widow shall have an equal right (50:50 rights) along with her surviving son over the portion of the deceased husband's share. For any further guidance you may contact any local lawyer from from Path Legal.

As per the Hindu Succession Act if the male Hindu dies intestate, i.e without making any will, the wife and the son shall get or inherit equal shares. Hence the son and the wife of the brother shall inherit equal shares, i.e. the son shall get 1/6th share and the wife shall get 1/6th share out of the said estate. All the best. Regards.
