what is the right of my wife in property.
29-May-2023 (In Property Law)
1. My wife is adopted child by her Uncle (father's real Brother)
2. no adoption formalities was occurred.
3. My wife 's school certificate, Pan Card, Job Paper, Father's Pension Paper and in all other documents mention adopted father as father name
4. Her father expired on Dec-20.
5. All properties are named on mother's name.
6.Mother wants give her property to her bhatije (Father's Batije)
Please advice, what is the right of my wife in property.
if you have any proof that your wife is the real daughter of her original father like birth certificate etc then on that basis your wife can claim herself as legal heir and apply for legal heirs certificate. on the basis of this legal heir certificate your wife can claim her share in the property of her father. if you need any further information or clarification then please contact me
Since these are the self acquired properties of her mother, any right that accrues in your wife to inherit these properties accrue only in case her mother dies intestate. During the mother’s lifetime, she is free to pass on her properties to any persoon as per her wish and your wife cannot complaint against this
