What is the process for selling an intestate property?

Hi Sir/Madam, My Grand Father passed away without writing an will. Even my dad also. My grand father has 6 sons, and 1 daughter. So, one of my paternal uncle sold some portion of property without remaining 5 brothers and 1 sister's signature. Is this legal? Can remaining 5 brothers and 1 sister sell the property individually?

Your paternal uncle & sister are the legal heirs of your grandfather. They succeed to your grandfather's property in equal shares. You inherit the share of your father. You can fight for the share of your father. Unless there was a partition and shares are specified amongst your father , his brothers & sister they cannot sell the property individually.

As the property was of your grand father then all the children's of him are entitle as your uncle has solely sold some portion then you can file a case against your uncle and the purchaser as well.
