What is the mothers share in ancestral property

My mother was expired before 10 years ago. We are two son of my mother.we want a share from my grandfather (nana ji) ancestral property. Now property registered on my grandfather (nana ji )name and he is alive. Can we claim him for my mothers share. Plz sir advice me....

Yes property can be claimed for a period of 12 years after your mother's expiration. You and your brother will be entitled to half your mother's share each. You need to file a civil suit to claim your share of the property.

It's depends upon the type of property. If the property is testamentary means if your Nana ji already transfer his share to their son or any other person then you have no right to enforce.
If the property is intestate then you have right to share that property.
If there is any dispute then u have to file civil suit for declaration. And if there is no dispute then you easily transfer property in your favour.
