What is the legal procedure needed to rent a flat

I would like to obtain the answers of the following queries: (1) Am I individually allowed to let any flat which is also co-owned by my wife? (2) Whether rent received from the tenant is to be divided between husband & wife, if anyone is legally allowed to let their flat? (3) What documents are needed from the tenant for future security & safety? (4) Receipt of rent by cash or through Bank A/C, whichever is legally supported?

Dear client,
As per the details given by you it is suggested that first you should be clear that for what period of time you want to let the flat if it is for fixed period then I must suggest that you should execute Leave and Licence agreement because once you accept the person to be tenant then he acquires certain rights in the said property as tenant and for his eviction you will have have to abide by the Tenancy Laws which is bit tiresome but if you go for Leave and Licence agreement the said person will not acquire any right and his eviction will be bit easy comparatively.

Opt for leave & license agreement for 11 months without renewal condition.Take ten post dated cheques and first month's licence fee in advance.obtain power of attorney from your wife since she is the co-owner.It is the joint decision to be taken by you and your wife as to how license fee to be disturbed between yourselves.Without fail keep the local police station informed of the whereabouts of the incumbent licencee.
