We had recently made a notarised sale agreement for a Muda site.
20-Oct-2024 (In Property Law)
The seller had taken time to provide the requested documentation until 18/oct/2024 but was unable to provide the requested documents. In the middle of this the sale agreement expired on 18/oct/2024. Now the seller is not accepting to sell the property to us also he is not returning the advance amount. He is telling he is going to deduct the 50000 out of 5 lakh advance amount as penalty. As per the law will he be liable to register the property to us?
Yes, the seller can still execute the property in your favor. However, it is essential to clarify whether the agreement you have with the seller is registered or unregistered. A registered agreement holds more legal validity and protection under the law, while an unregistered agreement may have limited enforceability. Please review your agreement and confirm its status. If it is unregistered, you may need to take additional legal steps to safeguard your rights. Once we have clarity on this, I will guide you on how to proceed with the property execution.
