My wife has 4 acre land behind which her brother is having 6acres and he is also having 3 acres opposite to my wifes land seperated by road. v have have patta passbook everything. Her brother wants to sell his 6 acres land and requesting us to give way through my wifes land, what ever the land v give for him , he will compensate by giving same amount land opposite to the my wifes land . Do v go through entire registration or 100 rupees stamp paper is enough?
If your wife wants to give a way through her 4 acres to her brother's 6 acres, and in return he is offering the same amount of land from his 3 acres on the opposite side, then this is considered a land exchange. Just writing this on a ₹100 stamp paper is not enough or legally valid. You both must register an Exchange Deed at the Sub-Registrar Office. Once that is done, you can apply to update the Pattadar Passbook and land records to reflect the new ownership. Also, it is important to make sure the land being given in exchange is not assigned or restricted land. Only a registered document can legally protect both of you and avoid future problems.
