Wants to apply for home loan on the property inherited by father

I inherited a property from my father and intend to build a home there. My father and mother both expired, My father left a will that the property will belong to me and my two elder sisters. Both my sisters are mentally retarted and unmarried. They stay will me and I take care of them. I am married and have 2 kids. The property is still in the name of my father and myself and my sisters are legal heirs. I want to take a home loan and build a house in that property. Please me know if I can take a home loan with an NOC from my sisters? Please guide me.

First have to obtain Legal Heir Certificate through Advocate to proof that you and your sisters are only legal heirs of your parents then if they mentally retired in that case Agreement/ Noc any thing which executed by the Mental person is declared as Null and Void , so in your case no need of any NOC, just you have to obtain Legal Heirs Certificate. according to your question your father has written a will to make you as legal heir along with your sister. to get the loan on your property you have to probate the will first, after probating the will you will get eligibility to become the owner then you may apply for the home loan
