Want To Remove My Sister From My Flat

I have co owned flat with my mother. After marriage I moved to rented house to avoid flights which my mother used to take up with my wife. After sometime my sister got married and now she is divorced. As house is co owned by my mother and me she claims that she can stay in the house as its her parents house. I want to remove here from my house. What l can do legally in this case.

Well, you cannot legally remove her from the house until and unless, you become the sole owner of the House by convincing your mother tp gift deed her share to you, once you become the owner of your Mother's share, then by combining your share with your mother's share, you become the sole owner of the flat/house, then, you will become legally eligible to direct your sister to evict your flat.

You can always approach the Court seeking partition of the property which is co-owned by you. It is by seeking partition that you'll be able to avoid your sister. Feel free to contact me for seeking any legal advice as regards the same.
