want to claim a share of a property that is being used by my uncle
12-Jan-2025 (In Property Law)
My grandfather had seven daughters, one of whom is my mother. He owned 3 acres of land and passed away in 2012. Since his death, the entire land has been used solely by one of my uncles (my mother’s sister’s husband). We want to claim our share of the property. What steps should we take to proceed?
In order to claim a share for your mother in your grandfather's property, you can seek partition of the said property. In order to do so, you can enter into a family arrangement wherein share in the said property can be apportioned. Feel free to contact me for seeking any legal advice as regards the same.
First of all let us know if there was any will of the grandfather or any agreement. If not then first you should file a succession / heirship petition on the. Ame of your mother. Further for the matter that the land is being used by your uncle write a notice to him to give your mother he share and if doesn't then legal steps can be taken but heirship petition is mandatory.
