Want separation of property for taking loan

We have a house and an attached piece of land registered in name of my father and his brother.We want to make separate registration for my family so that i can apply student loan for my further studies.My uncle's family is delaying to talk about this.There are not ready to sign the papers.What should i do proceed leagally.
If the property is registered in the name of your father and his brother, then you can claim partition of the property right away so that the properties are split between the two papers. you can also ask the court to permit you to take a loan on the joint property to the extent of 1/2 of your share for the purpose of education loan till the disposal of the suit.
