unregistered flat owners association

original parent documents not traceable due to sudden death of a flat owner in whose cutody the origianl parent documents were kept. A flat owner incurs some legal consultation fees for proceeding against some other flat owners. He claims the expenditure incurred towards consultation without giving the identiy of the advocate ie payee ie his contact number and address and without any update or opinion from the advocate consulted. Can such expenditure be allowed by members? if allowed can another flat owner proceed against them?

Commonly original parent documents are not required for subsequent buyers. Copy of documents enough for any legal procedure and if you need an original version file complaint through flat association before the police station with basic and other relevant papers after file before sub-register you will get certified document and Please ask your Advocate to raise the Professional Bill so that you have a record for the amount payable as against services received and make the payments through Cheque/Bank transfer to the advocate

you cannot set what is the original parent documents whether it relates to the association that is the Memorandum of article are the parent documents means the land documents belong to the land when the parent document is a lost then you must give and paper Publication regarding the Lost documents and after that you proceed with the pole is compliant where it lost on the police station on the day of the Lost and after the process of the pole is there will give the non traceable certificate after the non traceable certificate the copy of the document which we get from the registered office is treated as original
