Unable to sell 2BHK flat as 2 daughters are demanding equal share
23-May-2025 (In Property Law)
I am senior Citizen and have 1 son and 2 daughters. The share certificate has been issued jointly in both names in 1986. My late husband had made a nomination 100% in my name. If the property gets sold I wished to keep 50% of the sale proceeds of the flat and the remaining 50% to be shared equally by myself, my son and 2 married daughters. But my two daughters are not accepting my offer eventhough they have not made any contribution and are demanding equal share of the property.
Dear Client,
On the basis of information provided, it’s observed that, The flat was originally in the name of yourself and your late husband. Further it is observed that your late husband had made hundred percent nomination in your name.
Now it seems that you out of your natural love and affection towards your children intend to sell of the said property, by giving 50% sale proceeds to your children.
What your daughters seem to demand is a little bit unfair. However, in order to provide accurate legal opinion, more light needs to be shed in the matter

Well, if your Deceased Husband had made you 100 % Nominee for the Society Flat, it doesn't mean, that, you own that Flat, as other legal heirs have equal share in that Flat, considering, your Deceased Husband failed to make a Will and he died Interstate, nomination has no value if such nomination gets opposed by other Legal Heirs for a Property, either Will or Letters of Administration on the basis of Will or Without Will carry more legal weightage than Nomination for owning a Property!
you can file a suit for partition and you have all the right to sell your share of the flat. vice versa of your daughters are harassing u then can file a case against them under the welfare of parents and senior citizens act and seek maintenance as well from your kids. they will automatically come to you for settlement
