TRESPASSING AND ILLEGAL CONSTRUCTION BY BUILDER ON OUR PROPERTY

We have all the original property related papers since 1963 of Bk.no.405 Ulhasnagar-1,the Builder has submitted all the papers such as: the Plan passed from the Ulhasnagar Municipal Corporation, Agreement to sales, the Bogus Conveyance deed (Sanad) of the property at the add:Near Bk.no.391, Ulhasnagar-1. The builder has made an illegal encroachment of the structure on the plot of our shops,we have made many complaints to the U.M.C and the Police, but till date no result. We have not approached the Court as We don't know the law. we are Hindu. Please advice. Regards

Sir no action taken by UMC or Police indicate that system never work though there is injustice with common man. But for this there is solution to approach the court of law and get your right as provided.

The information supplied by you is inadequate, it is not clear whether part of your plot or all of it is encorached or whether illegal construction is made on your property basis a bogus sale deed.
Please refer to the Citizens Charter of UMC and if possible query the status of your Compliant registered with the Municipal Corporation through RTI. You can also seek boundary assessment if the encorachment is in part with the Tahsildar or the Concerned Authority. In the last you may require to approach the Civil Court for appropriate remedy viz. Injunction, demolition or eviction as the case maybe. Make sure you have all the evidences at hand such as Police Compliant, Compliant rgistered with the Municipal Body etc. You might require assistance from a local lawyer conversant with handling such cases in your area.

Dear u may move to court on d basis of wat all d docs u hv with u in consultation wid a lawyer to file a case of tresspassing...fraud n forgery even of cheating...n for possession as u all r d real owners....its a civil case n thus Der ll b less interaction frm d side of police...

If you are Owner of the Plot, you are well protected by the Law and Legal Machinery. You can file Injunction Suit before the Civil Judge Senior Division at Ulhasnagar and obtain Stay Order against the Builder. Rest assure you have all remedies available under the law.
