TRANSFERRING OF PROPERTY FROM MOTHER TO SON

ear sir, My mother want to transfer her property (house) to me for which construction loan installment has been paid by me every month from last 8 years. Now my brother is raising issue and asking share in the property but my mom want to transfer the same to my name. I wanted to know whether my mom can transfer the property without my brother sign or clearance, if transferred to my name whether serious legal issue will raise on me or on my mother. Please provide me the solution

dear sir,

if the property is a self acquired by your mother, then she can gift it to you and your brother's signature is not required and he can not challenge the same. the gift deed should be registered and thereafter khatha needs to be transferred.

If the proprty is your mother's self acquired property or her maternal side property then she can execute gift or Will as per her sole discreation. If not then she dnt have a right to transfer the right of the property exclusively in your name. You have not mentioned wheather it's an self acquired property of your mother or her ancestral maternal property or she got it through her husband or it is your father's self acquired property or he died intestate
