Transfer of Tenancy under MHADA

27-Apr-2023 (In Property Law)
I have purchased a house from a person who has been alloted by MHADA in 1995. I have purchased (unknowingly the rules) that house in 1997 with all the NOC and No Due Confirmation from Society also. In the year 2011 I have also registered my agreement with registrar. But My name is not yet transferred in MHADA record, When I approached to to MHADA official for transfer of name to my name they said name can't be transfer as the above said property is purchased within prescribed time period of 5 years. Can you please suggest me any other way or any safer way.

Sure, I will tell you legal ways to transfer MHADA Flat on your name. However, if the transfer of MHADA alloted Flat will not be permissible in Law, then you will be left with no option, but to illegally remain in that House and any legal action will be taken against you either by MHADA or the Original Allotee in future, to get back their flat.
