Transfer of shares of residential property

My mother is 60% owner of the house and me and my 3 siblings are owner of 10% shares each. My mother wants to transfer 30% shares in my name. What is the procedure and will the other 3 siblings have to agree with this transfer?

Yes. If your mother is the registered owner of the 60% share, she can transfer 30% of her share to you through a registered Gift Deed. The other three siblings’ consent/NOC is generally not required during your mother’s lifetime, provided the property is her self-acquired property and she is competent to transfer it. After registration, you would hold 40% total (your existing 10% + gifted 30%).

No they don’t have to agree in this case all you need to do is make a registered will or a gift deed, the exactly documentation to me made will be clear after looking at your papers sir. You can get in contact I shall consult you with the same

If your mother wants to transfer the shares in your name she can get it done officially via registered gift deed before this sub registrar, Mumbai division this process does not require an NOC from society but after registration of gift deed you need to give a letter to society stating that you have done give deal and transfer the share as per the ratio mentioned in the gift of the shares also there is no time duty involved in gift there is only 1% metro cess along with rs 1000 duty and 500 rupees registration charges for a registration and some scanning charges, and that's it your share should be transferred easily after this to register deed
