Transfer of property of mother in law after her death

20-Nov-2023 (In Property Law)
My mother in law passed away 2 years back and she has gifted the property in her name to her only child my husband. My husband passed away recently. I am his second wife and he had a daughter from his first marriage. She is above 25 years of age and is married. Can I transfer the property which my husband has got as a gift from my mother in law in my name or do I need to take a NOC from his daughter from first marriage.

Hi....From your question it is not clear that which personal law is applicable to you.... If you belong to Hindu you and the step daughter have the equal right on the share of the property of your husband. If you want to register the document on your name you may ask the step daughter to execute a gift or release deed in favour of you. Mere NOC wont work here.
