If the plot is legally owned by your brother-in-law and there are no restrictions in the Society bye-laws, the transfer can be effected through a duly executed and registered Gift Deed. Before proceeding, verify the title documents, allotment letter, society records, encumbrance status, and ensure that there are no dues, mortgages, liens, or transfer restrictions. Obtain the Society’s NOC/approval if required under its bye-laws. After registration of the Gift Deed, apply for mutation in municipal/revenue records and update the Society membership records. Since the transfer is from wife's brother to you (not a direct blood relative under stamp duty exemptions), applicable stamp duty and registration charges should be verified as per Madhya Pradesh law. A detailed examination of the Society rules and title documents is advisable before execution.
