Transfer of house flat/property post death of father

Hi Post my fathers death, as mentioned in his will, his flat in an housing society, was to be given to my wife. For the same, please advise: a. Will only getting a fresh share certificate issued in the name of my wife from the housing society transfer the flat ownership in her name or b. Do we have also have to get the ownership transfer registered in the Sub Registrar office / local Talathi office. Regards, Sudeep

Was there a will?

Is the property a pagdi?

If it is on ownership basis then you would have to obtain probate or Letter of Administration.. Unless your society agrees to transfer the same without these then it is well and good and will save u some money

This is my response to you:
1. Share certificate does not transfer ownership;
2. Please enter into a release deed and register the same;
3. Also you will need to obtain LOA from HC;
4. Consult a local lawyer and take steps.
