Tranfer Of Share Certificate In My Mother's Name After Father's Death
06-Nov-2024 (In Property Law)
I want to the share certificate of my father's self acquired property to be transfered in my mother's name.I father has already made a will in my mother's favour.
If your father has made a will in favor of your mother, stating that she is to inherit his self-acquired property, the property ownership can be transferred to your mother upon his demise. A will is a legal document that allows a person to specify who will inherit their assets after their death. Since the property is self-acquired, your father has full rights to bequeath it as he wishes.
To transfer the share certificate in your mother’s name, you will need to follow certain steps after your father’s passing. First, the will must be probated if required by the local authorities (especially if the property is in Mumbai, Kolkata, or Chennai, where probate is mandatory for wills). Probate is the legal process through which a will is validated by a court. Once the will is probated, it legally authorizes the transfer of the property to the beneficiary, in this case, your mother.
After obtaining the probate, you can approach the society or the relevant authority where the property is located to transfer the share certificate. You will need to provide them with the probated will, your mother’s identification proof, and other documents they may require. The society will then update the records and issue a share certificate in your mother’s name.
This process ensures a smooth transfer of property as per your father’s wishes outlined in the will.
