Torture and removal from house after husband's death

The flat agreement has both my name and my husband's name (1st owner). I have paid a lot of money for the flat..... My husband is jobless and an alcoholic since 2yrs ....he has beaten me in the past when I tried to explain to him that he should stop drinking, as it is affecting both personal and professional life. Because of his abusive nature, we stay in separate rooms. I have 2daughters aged 14 and 11. my fear is that due to his excessive drinking, he might not survive too long. In the past, my mother in law has threatened me many times, that she will ensure my daughters and I are thrown out of my house so that she can live here. what are my rights in that case?

As per your query You can approach the Hon'ble Court by filing an application under the Domestic Violence Act seeking protection against the violence from your husband and threats from your mother in law. You can also seek residence from the court. Secondly you can seek your share in joint ownership flat by filing a suit for the same. Regards
