Token money not returned by owner as i cancelled booking.

I gave some money as token money to a person for buying his house in April 2015. But due to some reason I could not buy that property and intimated him accordingly within 15 days. Till today he has returned my money. He has already done agreement with some other person. Every time he is giving some excuses. I have had with me a xerox copy of that cheque through which I paid him with his signature on that. Please advise.
