Token money not being returned after agricultural land deal cancelled

Respected Sir, I had finalized one agricultural land deal with Mr. Kale for an agreed terms and conditions in which He said that He will give us 15 ft broad and 50 meter long land part from main road as a pandhan(Road) to enter into the Farm which He was ready to give in writing. So we gave him Rs. 50000 by cheque as a token which He said that will be returned If the deal is cancelled. But then He deferred from agreed terms and cancelled the deal. Now He is not returning our money. Its been 8 months now but He has not returned our money. Now can I file FIR against himor do anything legal so that I can get my money back. Sir please help me.

Once the legal notice is sent and the money is not returned then you will have to file civil case for recovery of money and also criminal complaint to police for cheating you.

U need to give notice for recovery of 50k to mr. Kale.
If he don't give then u can file case of cheating and file F I R in local police station. This to recovery money as per agreement u need to do .
