Token amount refund -- How to get initial amount refund from seller

I have given 5L token (cheque) amount for a resale property before lockdown but now there will be an issue with future payments and emi as there no future income prospects because of lockdown. how can i proceed to get my token amount back and is the seller is liable to refund the amount from a legal point of view. till now no paperwork/agreement to sell is done
Well, Agreement is must so that it can be termed as sale agreement/allotment letter.
anyway, was this done through neft/rtgs or what was the mode. if online, did you mention in the reference transaction- token amount or towards sale agreement, etc
if no, you are at weak position. however, he must refund the amount to you if you cant go ahead. he may deduct/forfeit certain amount but you dont tell him on this but be ready for it.
if he deducts 50k to 1lkh let him as a last option and receive rest of the amount because if you challenge it in court, you will pay more then.
so for 5 lakhs amount, ask him to refund else police complaint.
