Title Dispute - No rights declaration Affidavit lost.

My dad bought a property in 1971 in his sisters name bcoz she was a teacher and the society was Teachers colony, My dad paid and we are occupying that flat since 1971. My Aunt made an affidavit in 1973 in Special Metropolitan Magistrate court for declaration of no rights. I have zerox of it. My aunt has filed a case against me in small causes in 2009 stating that flat belongs to her as the share certificate is in her name. Any chance I can retrieve copy of affidavit or records from the court?

You can make an application for a certified copy of the record in the Metropolitan Court for retrieving the no rights declaration copy by your aunt. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Well, I can assist you in getting such records from the Small Causes Court which you want. You will not only get Affidavit but all records from Court by paying the Official Court fees to derive the same from the Court.
