Tenant not vacating the house and not paying rent

Dear Sir/Mam I have a GMADA alloted property in Mohali, Punjab. I rent out my Top floor to a old age couple one and a half year back. But since last three months I have not been paid any rent since last three months by the tenant as they have gone through some economic crises. They are old Couple and unable to do Job. I had given them verbal notice to vacate house but they are denying it to do so. What Legal action could I take as I have not made any rent deed.

You can file an eviction case on the ground of non payment of rent and for more grounds must check the terms of agreement.you can evict claiming for personal use. If he deposit the due rent in the court then he need not have to vacate.

Dear Sir, the property under tenancy can be vacated form the tenants by moving the petition before the rent controller in the court. I shall advise you to file the petition seeking ejectment of the tenants from your property on the ground of non-payment of rent and also for for your personal need as well.
