Since both brothers have inherited the property under the Will, if one brother wants to take exclusive ownership by paying the other brother his share, the transaction should be properly documented and registered. Depending upon the exact facts and title, a registered Release/Relinquishment Deed, Family Settlement or Partition Deed may be appropriate. The document should clearly mention the property details, each brother’s inherited share, consideration paid, mode of payment, and that the receiving brother has no further claim or right in the property. Before execution, conduct a complete title and encumbrance check, verify the Will, death certificates, previous title documents, mutation/revenue records and any existing loan, mortgage, litigation or dues. Stamp duty and registration charges will also apply as per the applicable State law. Obtain the necessary NOCs and ensure mutation of the property in the sole owner’s name after registration. Avoid relying only on an unregistered agreement or receipt, as it may create future disputes.

Dear sir To ensure full ownership and eliminate future legal risks, you must execute a registered Relinquishment Deed or a Sale Deed accompanied by specific supporting documentation Stamp duty registration fees, and legal drafting charges apply and are usually borne by the buyer unless mutually agreed otherwise visit my profile for more legal help

Sir, as both of you brothers are ready for transferring the property solely on your name, you need to get a relinquishment deed executed by your brother in your favour and get it registered before Sub-Registrar. However, the part where you express your genuine concern with respect to avoiding possible future legal ramifications, I would suggest you both to formally get a family settlement agreement made between you two and that too by entering into a pre-litigation mediation, the process of which is very easy and a solid one, as the deeds that are made in pre-litigation mediation are as good as a court's decree itself, which will certainly erase any future legal complications and you'll have gour peace of mind.

Since both brothers have inherited the property under the Will, one brother can transfer his entire share to the other through a properly drafted and registered Relinquishment/Release Deed. The deed should clearly mention the full and final amount paid and state that the outgoing brother will have no future right, title, interest or claim in the property. Before registration, the Will, death certificates, title documents, legal-heir details, property dues and encumbrances should be verified.
