Taking loan on Property which is in dispute .

I am in very much need of loan .I belong to a Hindu family.By my family members concent,I have a flat which is owned by me .But my brother stays there.Now I want to take a loan by mortgaging that flat,but the society committee members are denying me for NOC.What should I do ?Can anyone help me out in this matter.I am ready to pay fees to the one who will help me to get out of this matter ,but after the loan work is accomplished.After my legal and loan work is done by you I will definitely pay you as per your satisfaction.Lawyers from Mumbai preferable.

My Response to your query:

You wish to take lone on your property in possession with your brother. As you are saying your family concept is obtained by you.

please check your brother has objected for noc or not.

chances that your brother has objected for NOC.

What reason given by managing committee that you have not mentioned in your query.
If you have purchased that flat from your own income then that flat can be treated as your self acquired property.If you want to evict brother from flat you can file case for possession of flat.

This is my response to you:
1. Is the sale deed in your name?
2. Is the share certificate in your name?
3. Then on that basis itself the society should hand over the loan to you;
4. Consult a local lawyer, discuss full facts and then take steps.
